1. Introduction, Scope & Binding Nature of This Policy

This Privacy Policy (“Policy”) governs how Squarelay (“Squarelay”, “we”, “us”, “our”) collects, uses, processes, stores, shares, or otherwise handles information in connection with the Squarelay platform, including but not limited to websites, dashboards, APIs, shortened or intermediary links, advertising services, analytics systems, communication tools, and all related technologies (collectively, the “Services”). This Policy applies to all users, including Creators, Publishers, Advertisers, Independent Advertisers, visitors, and any individual or entity interacting with Squarelay in any manner. By accessing or using the Services, you expressly acknowledge and agree that you have read, understood, and accepted this Policy in full, and that such acceptance is legally binding.

2. Squarelay’s Limited Role as a Technology Intermediary

Squarelay operates strictly as a technology-based intermediary platform. Squarelay does not create, upload, host, own, manage, review, edit, verify, or control Creator content, destination websites, advertiser landing pages, advertisements, tracking technologies, or external data collection mechanisms. Squarelay’s role is limited to providing a technical layer that facilitates link redirection and third-party advertisement display. As such, Squarelay does not assume responsibility for how information is collected, used, stored, or processed beyond what is strictly necessary to operate its own systems.

3. Categories of Information Collected (When Technically or Legally Required)

Squarelay may collect limited categories of information strictly for operational, security, compliance, and monetization purposes. This may include basic account details (such as email address or username), technical and usage data (such as IP address, browser type, device information, timestamps, and referral URLs), performance and traffic analytics (such as impressions, clicks, geographic estimates, and fraud indicators), and communication records (such as emails or support messages).

Tax-related or KYC information is not collected by default and shall be requested only if and when required by applicable law, regulation, government authority, payment processor, or financial compliance obligation. Squarelay does not voluntarily collect such information unless legally necessary.

4. Cookies, Tracking Technologies & Third-Party Systems

Squarelay may use cookies, pixels, SDKs, scripts, or similar technologies to operate the Services, analyze performance, detect fraud, and maintain security. Additionally, Third-Party Ad Networks and independent advertisers may deploy their own tracking technologies through advertisements or landing pages. Squarelay does not control, audit, or manage how such third parties collect or process data and expressly disclaims responsibility for their tracking practices, privacy policies, or compliance failures.

5. Use of Information & Business Purposes

Information collected by Squarelay is used strictly for legitimate business purposes, including but not limited to operating and maintaining the Services, facilitating advertising delivery, measuring traffic and revenue, preventing fraud and abuse, complying with legal obligations, processing payments, and communicating with users. Squarelay does not guarantee accuracy, completeness, or continuity of any data and does not represent that collected information will always be available, correct, or preserved.

6. Advertisements, Independent Advertisers & Data Responsibility

Advertisements displayed through Squarelay may be supplied by Third-Party Ad Networks or independent direct advertisers. Such advertisers may collect data directly from users interacting with their ads or landing pages. Squarelay does not control advertiser data collection, usage, storage, or security practices and bears no responsibility or liability for advertiser actions, claims, or data misuse. Any privacy concern related to an advertisement or advertiser must be addressed directly with the respective third party.

7. External Links, Destination Websites & Complete Disclaimer

Squarelay does not host destination websites and does not control external links accessed through Squarelay services. Any information collected by such external websites, including personal data, payment data, or device data, is governed exclusively by the privacy policies of those websites. Squarelay bears no responsibility for data collection, security, legality, or misuse by external sites, regardless of whether access occurred through a Squarelay link.

8. No Responsibility for Link Downtime, Errors or Availability

Squarelay does not guarantee that any link, destination website, advertisement, or service will be available, functional, uninterrupted, or error-free. Links may become inactive, suspended, blocked, redirected, modified, or removed at any time due to factors beyond Squarelay’s control. Squarelay shall not be responsible or liable for link downtime, broken links, lost traffic, lost revenue, or business interruption.

9. Viruses, Malware, Hacking & Technology Risks

Squarelay does not guarantee that the Services, advertisements, links, or external destinations are free from viruses, malware, spyware, ransomware, harmful code, or security vulnerabilities. Users acknowledge that internet usage inherently involves risk. Squarelay expressly disclaims all liability for device damage, data loss, unauthorized access, hacking incidents, or security breaches arising from use of the Services or interaction with third-party content.

10. Data Retention & Deletion

Squarelay retains information only for as long as reasonably necessary for operational, legal, compliance, or dispute-resolution purposes. Retention periods may vary based on data type and applicable law. Squarelay may delete, anonymize, or aggregate data at any time without notice and does not guarantee long-term preservation of any information.

11. Data Security Measures (No Absolute Assurance)

Squarelay implements reasonable technical and organizational safeguards to protect information. However, no system is completely secure. Squarelay does not warrant or guarantee absolute data security and shall not be liable for breaches resulting from third-party systems, user negligence, force majeure events, or circumstances beyond reasonable control.

12. User Responsibilities & Account Security

Users are solely responsible for maintaining the confidentiality of their login credentials and account access. Any activity conducted through a user account is deemed authorized by the user. Squarelay bears no responsibility for unauthorized access resulting from user negligence or compromised credentials.

13. No Monitoring or Verification Obligation

Squarelay has no obligation to actively monitor, verify, or audit user behavior, content, advertisements, links, or data processing practices of Creators or Advertisers. Squarelay’s role as an intermediary does not create a duty to investigate or prevent misuse unless required by law.

14. Children’s Privacy

The Services are not intended for individuals under the age of 18. Squarelay does not knowingly collect personal data from minors and disclaims liability for misrepresentation of age by users.

15. Legal Compliance, Intermediary Protection & Safe-Harbor

Squarelay operates as an intermediary under applicable laws, including the Information Technology Act, 2000 and related rules. Squarelay does not initiate, select, or modify transmitted content and is entitled to intermediary safe-harbor protections. Nothing in this Policy shall be construed as creating additional responsibility beyond what is required by law.

16. Changes to This Privacy Policy

Squarelay reserves the right to modify or update this Privacy Policy at any time. Changes become effective immediately upon publication. Continued use of the Services constitutes acceptance of the revised Policy.

17. Governing Law & Jurisdiction

This Privacy Policy shall be governed exclusively by the Laws of India, and all disputes shall be subject to the exclusive jurisdiction of the courts of Kanpur, India.
